The Calcutta High Court has decided not to pause the decision of the West Bengal Assembly Speaker regarding the appointment of Rittabrata Banerjee as the Leader of the Opposition. The court has ordered that Banerjee will remain in his position until further notice while a single bench resolves the matter within two months.

Background of the Dispute

This legal conflict began after the Trinamool Congress leadership proposed Sobhandeb Chattopadhyay as the Leader of the Opposition. However, the Speaker later recognized Rittabrata Banerjee for the role after a group of MLAs claimed he had majority support. Sobhandeb Chattopadhyay challenged this decision in the High Court, arguing that the party leadership should have the right to select their representative.

Court Proceedings and Arguments

The court examined why the initial proposal for Chattopadhyay was kept pending while the later proposal for Banerjee was processed quickly. The Speaker stated that he had to verify which candidate held the support of the majority of opposition MLAs. According to the Speaker, 58 out of 80 opposition MLAs personally appeared to support Rittabrata Banerjee.

During the hearing, the petitioners raised questions about the Speaker's decision, especially regarding the status of Banerjee’s membership in the party. The High Court bench, comprising Justice Shampa Sarkar and Justice Ajay Kumar Gupta, stated that it would not be appropriate to stop the assembly proceedings at this time.
